Bankruptcy

Liz represents debtors in bankruptcy cases. She understands that in the current economy, bankruptcy is often the only way for people to get a fresh start and end the sleepless nights caused by worries about unpaid debt and bills. Liz will talk with you during your initial consultation to help you decide whether bankruptcy is the best choice for you and your family.

  • Chapter 7 Bankruptcy. Chapter 7 bankruptcy is the most common type of bankruptcy. In Minnesota, a Chapter 7 bankruptcy will discharge an individual from most debt, including credit cards, medical bills, and other unsecured debt.
  • Chapter 13 Bankruptcy. Chapter 13 bankruptcy allows an individual to repay some of their debt through a 5-year plan.
  • Means Test. Depending on your income, you may have to pass the “means test” in order to file for Chapter 7 bankruptcy. If you do not pass the means test, you will be limited to filing for Chapter 13 bankruptcy.
  • Non-dischargeable debt. Bankruptcy does not discharge all debts. The following debts are non-dischargeable:
    • Alimony (spousal maintenance)
    • Child support
    • Back taxes
    • Recent purchases of more than $550 for luxury goods bought within 90 days of filing
    • Fines or penalties of government agencies
    • Fraudulent debts
    • Cash advances of $825 within 70 days of filing
    • Student loans (unless an undue hardship discharge is granted)

Liz was born in Owatonna, Minnesota, and grew up in Waseca, Minnesota. After she graduated from Waseca High School, she attended the University of Minnesota, where she received her Bachelor of Arts in Political Science and Global Studies. While she was in college, Liz spent a summer in Kingston, Jamaica, as an intern for Jamaica AIDS Support. She also lived in Santo Domingo, Dominican Republic, as a volunteer for Education for All: Project ABC. While Liz was in the Dominican Republic, she became fluent in Spanish.

After graduating from the University of Minnesota, Liz worked as a Legislative Clerk at the Minnesota Senate Information Office. She then returned to the Dominican Republic and taught English while continuing to volunteer for Education for All: Project ABC. When she returned to Minnesota, she worked as a Sales Intern for NextNet Wireless while preparing to attend law school.

Liz graduated magna cum laude from William Mitchell College of Law. While in law school, she clerked for the Minnesota Disability Law Center, Southern Minnesota Regional Legal Services (CORE Housing and Education Law Advocacy Project), and for a bankruptcy attorney. After law school, she worked with two family law attorneys, Stacy Wright and Jennifer Lewis Kannegeiter, who provided valuable mentorship.

Liz lives in Apple Valley, Minnesota, with her husband, Eric, and their dog, ChaChi. Liz is an active member of Shepherd of the Valley Lutheran church, where she teaches confirmation class and participates in a small group.
